Gift Deed

Pour Over Will

A Pour-Over Will is used if you have a Living Trust. Upon your death, a Pour-Over Will transfers any missed property to your Living Trust so that the property is distributed as specified in your Living Trust.

DOCUMENT INCLUDES:

  • A provision (or provisions) that state any assets not already placed in a living trust at the time of death should be transferred to that trust, essentially acting as a "catch-all" to ensure all assets are distributed according to the terms of the living trust, minimizing the need for full probate proceedings; it typically includes identifying the specific living trust and specifying that any remaining assets should be transferred to it upon death.

Revocable Living Trust

A Revocable Living Trust is a useful estate planning tool that allows the contributor to stay in control of their property as the trustee while they are alive and arrange how some or all of their assets will be managed after their passing. A living trust also avoids most probate fees.
